REACH PRE-REGISTRATION SUBSTANCES DIRECTORY FOR PLASTIC RECYCLERS

The European Plastics Recyclers association (EuPR, www.plasticsrecyclers.eu) will release the REACh Pre-registration Substances Directory for Plastics Recyclers on the 1st October. This directory has been compiled by plastics experts from PlasticsEurope, EuPC and EuPR. REACH, the new EU chemicals regulation, requires that chemical substances on their own, in preparations and those which are intentionally released from articles have to be registered to the European Chemicals Agency (ECHA). The obligation to register applies from 1 June 2008. The chemicals currently on the EU market which meet the definition of phase-in substances should be pre-registered between 1st June and 1st December 2008.

REACH legislation – Preregistration of PVC Substances in Recyclates

Every company active in recycling of PVC waste needs to face the new requirements of REACH regulations. The recycler himself does not fall directly under the Reach legislation for the incoming waste (which is ruled by the Waste Framework Directive) but all he sells to his customers purchasing the recycled material does. Every producer (converter) of e.g. flooring, roofing or pipes can ask any time the material supplier for a ‘Safety Data Sheet’ including the list of the classified substances with their registration number and in many cases the recycler has to supply the SDS automatically. There is no doubt than that in any case the recycler himself will be faced with the Reach requirements. All recyclers will have to pre-register a number of substances in their recycled material online, on the site of the European agency dealing with preregistration.

The pre-registration of substances by recyclers must be performed before 1st December 2008.

" The situation on "Reach and Recycling" has now been to a large extent clarified by EU Commission Services Note n° CA/24/2008 of 2 June 2008. We have analysed the document and we are now preparing our Stakeholder response to the Commission which has to be tabled by 7 July.

The support and step-by-step guidance to the recyclers regarding the REACH Regulations to navigate through the newest legislation, issues and problems will be provided by EuPR to its members during the summer months; in particular it is planned to provide the list of substances to be pre-registered. General information on Reach is provided on the EuPC (the European Plastics Converters Association) site www.plasticsconverters.eu. The Reach helpdesk is part of EuPC Services (www.eupcservices.org) and can be accessed through the following link: www.eupcservices.org/services/helpdesk.

It has been decided by the Management Committee of EuPR (the European Plastics Recyclers Association), that as a starter two training seminars will be organised in Brussels during the summer months (http://www.plasticsrecyclers.eu/news). They will be conducted by Mark Burstall and Walter Claes. The final dates have not been fixed, but it will be 29/31 July and 27/29 August. More trainings in different countries will follow later.

IMPORTANT MESSAGE TO OUR RECYCLERS !
SIGNIFICANTLY DELAYED DATA INPUT

Dear Recyclers registered within Recovinyl’s programme,

As all of you perfectly realize one of the requirements of our financial support system is regular online input of data. All information regarding the PVC waste your company would like to register in our system and which is supposed to be a subject to our incentive programme, should be implemented in the online system on weekly basis. If it is not possible to meet this requirement for any reason we urge all our recyclers to enter the data at least once a month.

Analyzing the records online we have noticed that many of the recyclers have not entered yet the data for the second quarter of 2008. Input of waste once a quarter, just at the end of it, is just unmanageable. It makes it delicate and complex to manage the incentive budget within Recovinyl. Facing this kind of problem, if the situation will not improve within short period of time, we will be forced to consider reallocation of the funds assigned to particular companies. The incentives of the applicable envelopes will have to be redistributed to those recyclers which entered their data on time and were doing that on more or less regular basis. The volume that has not been registered within the agreed time schedule could not be paid.

Please keep always in mind the basic requirements of our financial support concept for registered tonnage of post-consumer PVC waste streams. Recovinyl needs to convince its financing body as well. The fact of reserving almost 6Mio € in order to avoid further ban or tax legislation regarding the use of PVC, has a positive impact on the recyclers’ business.

In order to avoid discussions and misunderstandings, we would like to ask all our participating recyclers to start immediate and regular data input into Recovinyl’s system.

Being active in a recycling activity of plastics (in this particular case – PVC) you realize for sure that any changes within the REACH regulations have a strong influence on your business.

In order to help our recyclers in navigation through the newest regulations net and keep them updated and aware of any new issues and problems regarding REACH regulations, on 19th June 2008 in Bergamo, Italy EuPR (European Plastics Recyclers) organises a Working Group meeting during which new elements of the changing law and several issues regarding REACH will be introduced. Participation in such a working group will with no doubt, provide you with a guidance of how to comply with coming into force new REACH legislation.

Participation in this meeting is of high importance for the PVC recycling business. The latest progress and development of the Recovinyl’s activity will be also presented and discussed during the working group in Bergamo.

We realise that the meeting will be conducted in English only but none the less we would like to encourage as many recyclers as possible to take part in the discussion group meeting in Italy. We would like to keep you well informed about the evolution of our concept but also we are prepared to hear about the problems you face in everyday business. We strongly believe that working together and listening to each others will help us to find solution to many obstacles we face businesswise.

REACH Update, April 2008

This newsletter is intended to give some interim help and guidance to plastics recyclers over issues that may affect them as the new Reach Regulation starts to take effect. EuPR has been working hard with the European Commission to try and find simple and cost effective sulutions to the problems of working within the Reach system and has established a roadmap outlining the key steps that need to be achieved. A joint action plan has also been agreed with Plastics Europe and EuPC.

  1. It seems clear that plastic recyclers will need to provide safety data sheets if they produce either substances or preparations in their processes.

  2. The question of registration, and therefore of pre-registration remains unclear.
    • In a written answer to a question in the European Parliament, Mr. Verheugen has helped to clarify the interpretation of Article 2(7)(d). He has stated that "it is up to the manufacturers and importers of [plastic] recyclates to assess whether their material is a substance, a preparation or an article" and "it is up to the recycler to assess whether the recovered substance is the same as a substance already registered". EuPR will now work on providing a number of reasoned guidelines to help support an industry wide position on both issues.

    • ECHA has commented on pre-registration with the fullowing statement. "According to article 2(7)(d), substances which result from recovery are exempted from registration only if they are already registered. Consequently it is advisable that recyclers do pre register their substance, in case nobody finally register it and they would decide to do so, as otherwise the recycler would not be able to benefit from the transitional provisions." Preregistration is free and the pre-registration period runs from 1st June to 1st December 2008. There is no obligation to fullow up pre-registration with an actual registration but it does buy valuable time if actual registration becomes necessary. EuPR will provide guidance for plastics recyclers on the pre-registration process before the end of May 2008.

  3. There are some substances, typically historic additives that are no longer in use, which will probably not be registered under Reach. EuPR has joined with a number of other European industry bodies to request that such substances should be exempt from registration in the case of recycled plastics. This exemption is being requested under the ongoing review of Annex V of the Reach Regulation. If this request is not successful then registration of these substances will be necessary.

As noted above, the advice from ECHA is that plastic recyclers should consider pre-registration for the substances in their recycled material. The ECHA website does not yet have detailed guidance on the preregistration process although this is expected soon. However for those who want to prepare themselves before the EuPR guidance is issued, there is ECHA guidance on Data Sharing (ex-RIP 3.4), which contains a lot of information on Pre-registration, SIEFs etc.: document data_sharing_en.pdf should be helpful.

Operational results 2005-2007. Prognosis for 2008.
Our website now in 10 languages!

We are glad to announce that since 18th February 2008 our website is also available in Portuguese. A new banner – Portuguese this time, has appeared in the language selection bar in the right top corner. Every additional language in which our site is available means obviously expansion of our activities in new regions. After Italy which has joined lately our programme, Portugal is the 13th country where Recovinyl is present with its incentive concept. Currently we cooperate with 110 recyclers from 12 different countries.

Recovinyl is present on the market since June 2003. As far as we are active in more and more countries, registering increasing quantities of post-consumer PVC, we would like to present our operational results starting from 2005 and some forecasts for the nearest future.

The operational results published here start in 2005 as far as 2003 and 2004 was a testing phase. It was a process full of long debates and complicated consultations of other recycling systems. Full implementation of our concept within the PVC recycling sector in particular countries took us almost one and a half year.

At the beginning of our activity we concentrated our efforts on registration of only rigid PVC applications. In 2006 we have started also collection of flexible PVC like cables, flooring and roofing materials. The growing evolution in registration of rigid and flexible material is represented by the chart underneath. For comparison the total collected volume of post-consumer PVC material has been provided as well.

To achieve this volume in 2007 of collected and recycled PVC materials there must have been 8700 lines of waste input entered in the system of Recovinyl. This goal has been reached thanks to the daily input of the collected volume by the acredited recyclers in our web database.

We would also like to present the relation between the required investments we needed to incur in order to collect the achieved volume of post-consumer PVC materials.

We expect further expansion of our project. We plan to develop our activities not only within already existing markets but also to extend our actions towards new regions like Central Europe, Sweden and Austria. We are looking forward to meeting new potential partners showing interest in our programme and willing to join the efforts in registration of end-of-life PVC materials.

New "PVC SORTING GUIDE" for all users, members & recyclers now online!

We would like to inform all partners of Recovinyl"s program and users of our site that a new important element has been installed.

By choosing the home page of Recovinyl, a user can see an icon "DOWNLOAD OUR SORTING GUIDE" in right top corner. This document has been updated to the latest requirements of the Recovinyl"s system.

The "SORTING GUIDE" has been expanded also in volume to provide users with as much valid information as possible. The file is available online in .pdf format.

Its content describes in details the assumptions of the Recovinyl"s concept and requirements for the new potential partners to join the system.

The brochure presents also all necessary steps to be followed to become a recycler or a member of our programme and register your company on the site.

The "SORTING GUIDE" will for sure come in handy for already registered users of the site. It includes a lot of brief tips supported by photos of how to recognize various PVC waste categories (A & B Grade), what kind of PVC materials are covered by Recovinyl"s programme and which materials cannot be accepted.

The brochure includes as well presentation and examples of PVC applications, as much for rigid as for flexible materials, which can be found in the general waste streams.

If there is any doubt if the PVC waste you have in your possession can be covered by Recovinyl"s incentive programme, just take a look at our "SORTING GUIDE". All explanations presented there are supported with images to make a distinction between various kinds of PVC materials present in your delivery easier.

The "SORTING GUIDE" presents also all necessary contact data of our local partners per country. You can always make use of it and in case of any further doubts contact our agent in your native language to clarify the situation and answer all your questions.

Hopefully, users will find the new PVC brochure helpful and handy when participating in our programme and dealing with PVC rigid and flexible materials.

Recovinyl now also in Czech

With pleasure, we would like to inform all partners of our programme and the users of the site that Recovinyl’s activity is expanding.

So far the website of Recovinyl has been available in eight different languages: English, French, German, Danish, Italian, Spanish, Dutch and lately also in Polish.

In order to encourage new partners from other countries to combine the forces and join our programme of PVC recycling, from today on the site is available also in Czech.

We hope that the new users will find the new feature of the website a convenient tool in their daily site use. Surfing through our website in their native language should make the programme more transparent and more advantageous for the another-language users.

New Version of Our Website

We are delighted to inform all our customers and partners that the website of Recovinyl has got a new layout. It took our IT team some weeks to develop the new version (called by the specialists - v2), finalize some translation issues, to remove bugs appearing to our users and to improve the general functionality of the site.

Several features of the website have been changed and/or improved to enable users to work faster and more efficient. Some of the elements, which appeared to be confusing for them, have been removed or replaced by a new functions or layout format. Some of them are listed below:

  • "Lightweight" pages: reduced page-size from 300kb down to 60kb (every page should load five times faster than with the previous version).
  • Increased logging-in security.
  • Enhanced database connection (minimising connections "in the background", which results in faster downloading of a page).
  • Stretchable layout (different words in multiple languages, both: long and short words/sentences will be visible without any further problems of being cut in the middle. It appeared to be problematic for some languages).
  • Fully compliant with most modern browsers (Internet Explorer 7 / Firefox).
  • Enhanced page titles (Recovinyl - User Profile - User full name etc.)
  • Improved functionality for the most popular search engines on internet.
  • Better notifications on non-allowed login, lost password and sign-up page.

The functionality of the site stays the same and bug-testing function is also still active.

The new layout upgrade will be available to the users from the beginning of June 2007.

Un accord de partenariat entre Recovinyl et PVC Recyclage

Depuis le début de cette année, un accord de partenariat est intervenu entre Recovinyl et PVC recyclage.

PVC Recyclage est actif en France depuis 2001, dans le cadre de l'engagement volontaire des transformateurs français de PVC rigide. Sa mission est d'offrir une solution respectueuse de l'environnement pour la valorisation des déchets de PVC rigide par le recyclage.

Recovinyl pourra compter sur l'expertise de PVC Recyclage dans l'Hexagone pour implanter son système d'incitants financiers pour la collecte des déchets en PVC dans la construction et la démolition. La première phase de cette implantation consiste en la création d'un réseau de Recycleurs agréés à travers la France.

Pour atteindre cet objectif, des moyens financiers et humains sont mis en commun. Monsieur Benoît Leclère, déjà en charge du développement de Recovinyl pour la Belgique francophone et le Luxembourg, se consacrera aux 10 départements français frontaliers avec la Belgique.

Monsieur Francis Aublé, de PVC Recyclage, prendra en charge le reste de la France.

Afin d'assurer la pérennité du système, Recovinyl recherche un auditeur, pour la France, qui effectuera des audits réguliers auprès des acteurs de la chaine de collecte/recyclage.

Les premiers résultats de cette coopération dépassent les attentes des deux sociétés et laisse présager d'une coopération encore plus fructueuse pour l'avenir.

New appointed UK auditor

Mr. Stan Ebelewicz has been appointed as an auditor for the certified recyclers within the Recovinyl concept in the United Kingdom and Ireland.

Mr. Ebelewicz has 25 years of experience in Construction and Municipal solid waste management within many European countries.

Before the end of the year he should visit, together with our local agent David Wiles of AXION recycling, all officially registered and certified UK recyclers in order to audit the collected volumes of post-consumer PVC of 2005.

From this week on, members (collectors of waste, sorting waste parties) as well as potential recyclers can sign in, and receive a login with password.

Having these, contact data can be filled in, and the company profile can be completed as well.

First Payment for collected volumes

Today the first payment of the Recovinyl's incentive for collected post-consumer PVC has been executed. This payment took place at collectors in the Benelux as well as collectors in the United Kingdom. The collected volumes are higher then expected.

After acceptance it appeared that the quality of the delivered post-consumer PVC is right in line with the needs for further processing the material at the certified recyclers.
